Terms of Service
These Terms of Service (“Terms”) govern your use of my-dodo.com and your purchase or use of services provided by MY-DODO.
By using the website, submitting an order, accepting a proposal, paying an invoice, or engaging MY-DODO, you agree to these Terms and any applicable proposal, statement of work, or service agreement.
Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement. If you act for a business, you represent that you have authority to bind that business.
Services
MY-DODO offers services that may include Shopify development, store setup and management, website work, search engine optimization, content, marketing, audits, consultations, and related services.
The specific scope, deliverables, timing, fees, and revision allowances may be described on the website, in a proposal, invoice, statement of work, or separate agreement. If those documents conflict with these Terms, the more specific written agreement controls for that service.
Starting prices displayed on the website are estimates and do not guarantee a final project price.
Estimates and Results
Project dates and performance estimates are provided in good faith but are not guarantees. Timelines depend on scope, client cooperation, third-party platforms, approvals, and other circumstances.
MY-DODO does not guarantee search rankings, traffic, sales, revenue, advertising results, conversion rates, platform approval, or uninterrupted operation of third-party services.
Client Responsibilities
You agree to:
- Provide accurate information, materials, access, credentials, and feedback promptly
- Obtain all necessary rights and permissions for content you supply
- Review and approve deliverables
- Maintain secure backups and account access
- Pay invoices when due
- Comply with platform rules and applicable laws
- Make final business, legal, tax, accessibility, and regulatory decisions
You remain responsible for your products, services, claims, pricing, taxes, fulfillment, customer relationships, and legal compliance.
Payments
Payment schedules are stated at checkout, on the invoice, or in the applicable agreement. Unless otherwise agreed, invoices are due upon receipt.
MY-DODO may pause work or withhold delivery when payment is overdue. You are responsible for applicable taxes and approved third-party expenses.
Recurring services continue and are billed at the stated frequency until canceled. Renewal terms and cancellation instructions will be presented before enrollment.
Cancellations and Refunds
Cancellations and refunds are governed by the Return and Refund Policy and any applicable service agreement.
Revisions and Changes in Scope
Included revisions, if any, will be stated in the applicable service description or agreement. Requests beyond the approved scope may require a revised timeline and additional fees.
Intellectual Property
You retain ownership of materials you provide.
Unless otherwise stated in writing, after full payment you receive ownership of custom final deliverables specifically created for you. MY-DODO retains ownership of:
- Pre-existing materials
- General skills, knowledge, methods, systems, and processes
- Reusable code, templates, tools, and frameworks
- Concepts or drafts that were not selected
- Third-party materials and software
Third-party themes, applications, fonts, images, code, and platform features remain subject to their respective licenses.
Unless you request confidentiality in writing before publication, MY-DODO may identify you as a client and display publicly launched work in its portfolio and marketing materials. Confidential information and private account data will not be publicly disclosed.
Acceptable Use
You may not use the website or our services to:
- Violate laws or third-party rights
- Distribute malware or interfere with security
- Commit fraud or impersonate another person
- Scrape, copy, or exploit website content without permission
- Promote unlawful, deceptive, infringing, or abusive material
Third-Party Platforms
Services may depend on Shopify, Google, Meta, applications, hosting providers, registrars, payment providers, and other third parties.
MY-DODO does not control and is not responsible for third-party outages, policy changes, fees, account suspensions, security incidents, or decisions. Your use of those services is also governed by their terms.
Confidentiality
Each party will use reasonable care to protect non-public business information received from the other and will use it only for the applicable project. This obligation does not apply to information that is public, independently developed, lawfully received from another source, or required to be disclosed by law.
Disclaimer
The website and services are provided on an “as available” basis to the fullest extent permitted by law. MY-DODO does not provide legal, accounting, or tax advice.
Except for express commitments in a written agreement, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.
Limitation of Liability
To the fullest extent permitted by law, MY-DODO will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities.
To the fullest extent permitted by law, MY-DODO’s total liability arising from a particular service will not exceed the amount you paid MY-DODO for that service during the six months preceding the event giving rise to the claim.
These limitations do not apply where prohibited by law.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold MY-DODO harmless from third-party claims arising from materials you provide, your products or services, your unlawful conduct, or your violation of these Terms or another party’s rights.
Termination
We may suspend or terminate website access or services for nonpayment, abuse, unlawful conduct, security risks, or material breach. Amounts owed for completed work and committed expenses remain payable.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute not subject to a different written agreement will be brought in a court of competent jurisdiction located in Los Angeles County, California, unless applicable consumer law requires otherwise.
Before filing a claim, the parties agree to attempt in good faith to resolve the dispute informally by written notice.
Changes
We may update these Terms by posting a revised version with a new effective date. Changes do not retroactively alter an already signed project agreement unless both parties agree.
